EMPLOYMENT BASED GREEN CARD


For you or a family member to obtain an employment based Green Card, a foreign national must be sponsored or eligible for a Green Card through Employment.

The Law Office of Brian T. O’Neill can counsel you and the employer through the Employment Based Stages of the Employment Based Green Card process.

Generally, in order to qualify for an employment based Green Card, you must be sponsored by an employer through the Labor Certification process. In order to obtain a Green Card through Labor Certification, an employer must conduct ‘recruitment’ and file an application with the US Department of Labor that shows NO willing, minimally, qualified, ready, willing or able American Workers were available to fill the open and available position that has been advertised by the employer . Certain categories of applicants are eligible to obtain an employment based green card without a labor certification.

Obtaining a Green Card through an Employment Alien Labor Certification?

Beneficiaries of an approved Labor certification are not always immediately eligible to apply for a green Card. Green Card applications are accepted based on a preference system, with priority going to foreign nationals who will fill jobs that require an advanced degree and experience, then down the line through Bachelors degree and/or experience, to jobs requiring little or no experience or training.

Obtain a Green card without an Employer Alien Labor Certification?

Applicants who qualify is one of the categories that do not require alien labor certification obtain a green card faster that applicants whose prospective employers are required to test the labor market.​
